Terms of Service

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

• "Service" — the Bozuro platform, website, APIs, and related tools.
• "Customer Data" — the contacts, content, and other data you import or create in Bozuro.
• "Recipient" — a person to whom you send email or SMS through the Service.
• "Agreement" — these Terms together with any order form, the Privacy Notice, and the DPA.

You must provide accurate information, keep it up to date, and be at least the age of majority in your jurisdiction. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at [email protected] of any unauthorized use.

Bozuro provides tools to collect contacts, manage customer profiles, build segments, and send email and SMS campaigns and automated flows. We may add, change, or remove features over time. Features labeled beta or early access are provided as-is and may change or be withdrawn.

You agree not to use the Service to:

• Send messages to people who have not consented, or after they have opted out;
• Send unlawful, deceptive, harassing, or infringing content;
• Distribute malware, or attempt to gain unauthorized access to the Service or its systems;
• Reverse engineer, resell, or overload the Service, or circumvent its limits or security;
• Violate any applicable law or the rights of others.

We may investigate and suspend accounts that violate this section.

As between you and Bozuro, you own your Customer Data. You grant us a limited license to host and process it solely to provide and improve the Service, as described in our Privacy Notice and DPA.

You are solely responsible for compliance with the laws that govern your messaging — including CAN-SPAM, the TCPA, GDPR, and CASL as applicable. This means obtaining and recording valid consent, honoring opt-outs, sending only to recipients who agreed to hear from you, and including required sender information. Bozuro provides tools to help — such as one-click unsubscribe and SMS STOP handling — but the obligation to comply is yours.

Paid plans are billed in advance for the plan you select. SMS is billed using credits included with your plan; usage beyond your included credits is metered at the carrier's rate with no Bozuro markup, and you can cap your spend. Fees are exclusive of taxes, which you are responsible for. Except where required by law, fees are non-refundable. We may change pricing on renewal with notice.

The Service can connect to third-party platforms such as Shopify, WooCommerce, and Magento. Your use of those platforms is governed by their own terms, and we are not responsible for third-party services or for data you direct us to exchange with them.

Bozuro and its licensors own all rights in the Service, including its software, design, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights in your Customer Data. If you give us feedback, you grant us a license to use it without restriction.

Each party may access non-public information of the other. Each party agrees to protect the other's confidential information with reasonable care and to use it only to perform under the Agreement, except where disclosure is required by law.

The Agreement continues while you use the Service. You may cancel at any time from your account settings. We may suspend or terminate your access for breach of these Terms, non-payment, or to comply with the law. On termination, your right to use the Service ends; you may export your Customer Data during a reasonable window, after which it is deleted or returned as described in the DPA.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, and we do not guarantee message deliverability, open rates, or any specific marketing outcome.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Each party's total liability arising out of the Agreement is limited to the amount you paid to Bozuro in the twelve months before the event giving rise to the claim.

You agree to defend and indemnify Bozuro against claims arising from your Customer Data, your messages, your use of the Service, or your violation of these Terms or of the sending laws described in Section 6.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide notice where required. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws applicable to the Bozuro contracting entity, without regard to conflict-of-laws rules. The specific governing law and venue applicable to your account are set out in your order form or available on request from [email protected]. The parties will first attempt to resolve any dispute in good faith.
